Cancellation Policy:
For all tours, up to 48 hours before departure, no penalty, beyond that limit, the full cancellation penalty applies. For excursions outside New York, up to 72 hours before departure, no penalty, beyond that limit, the full cancellation penalty applies. For tickets and other services sold on our website, the terms and conditions specified in the respective product sheet apply. Please read carefully the terms and conditions of each product listed on the website.
Reservation:
You can book our tours and services online at ilmioviaggioanewyork.com or at our office located at 324 W 47 Street, New York, 10036.
Confirmation:
After booking, you will receive an automatic confirmation of the purchased services. In some cases, the confirmation serves as the ticket, while in others, you will need to wait for the ticket to be received within 24 hours in your email. Please also check your SPAM folder. Some tours do not have guaranteed departure, so you may receive a cancellation notice by email or phone at least 12 hours before the tour departure. Receipt of confirmation or payment implies acceptance of the terms and conditions of participation in the tour outlined below.
Rates and Payment Procedure:
All displayed rates are retail and are expressed in USD. Prices can undergo changes at any time. Reservations made before any price changes will be honored at the rate in effect at the time of confirmation. Payment can be made with credit card, debit card, Paypal, Google Pay, or Facebook Pay. For transactions exceeding $2000, you can make the payment via international bank transfer upon request via email. We are not responsible for the USD-Euro exchange rates at the time of payment or refund for a service.
General Information:
For the comfort and safety of all passengers, the following conditions apply: smoking is not allowed on the bus. Stops along the route are planned according to the scheduled itinerary of each tour. The seating arrangement inside the bus is at the discretion of the guide. Tours may be multilingual. My trip to New York reserves the right to refuse transportation to passengers whose behavior makes it difficult for the guide to conduct the tour or for the general well-being or enjoyment of the program by all participants on the respective tour.
Consent Clause for Recording and Usage on Social Media
The following provisions establish the terms and conditions under which participants in a tour or event (“Participants”) grant their consent to be recorded and for the use of images and related content on the official social media channels of the tour organizer (“Organizer”).
1- Consent to the Processing of Personal Data and Images:
a) Participants understand and agree that during the tour/event, they may be photographed or recorded on video. Participants grant the Organizer the non-exclusive and unlimited right to capture, record, and use the images, voices, and performances of the Participants during the tour/event.
b) Use on Social Media:
Participants consent to their images and related content being published and shared on the Organizer’s official social media channels, which may include, but are not limited to, platforms such as Facebook, Instagram, Twitter, YouTube, etc.
2- Ownership Rights and Usage Limits:
c) Participants understand that the Organizer holds ownership rights to all images and content generated during the tour/event. However, the Organizer agrees to use such images and content exclusively for the purpose of promoting the tour/event and its related activities, without commercial or defamatory purposes.
3- Exclusion of Claims:
d) Participants waive any claims for compensation or copyright arising from the use of images and related content as provided in this clause.
4- Withdrawal of Consent:
e) Participants have the right to withdraw their consent at any time by providing written notice to the Organizer. However, the revocation of consent will not affect the use of images and content already published or shared prior to the revocation.
5- General Provisions:
f) This clause constitutes the entire agreement between the parties with regard to the use of the images and related content. By agreeing to participate in the tour/event, Participants confirm that they have read, understood, and accepted the terms and conditions of this consent clause.
Disclaimer/Responsibility:
My trip to New York is an independent contractor acting as a ground tour and service operator. The operator’s liability is strictly limited. The operator does not own or manage any of the services listed as “Tour operated by a third party” in the terms and conditions of a specific product; nor does it own or operate any means of transportation, hotel accommodations, or restaurants. My trip to New York collaborates with third-party companies for the resale of some services and, in some cases, directs customers to third-party websites to finalize the purchase of some offered products, including but not limited to: car rentals, tickets for shows and sporting events, attraction passes, luggage storage, hotels, and insurance.
If the services included in the tour cannot be provided or there are changes to the itinerary beyond the operator’s control, My trip to New York reserves the exclusive right to make changes to the itinerary or price without prior notice. My trip to New York is not responsible if the tour does not visit a location included in the program due to meteorological natural disasters, flight delays, illness, accidents, or any other reason beyond our control. In this case, no refund is provided for the services not utilized.
My trip to New York is not responsible for any losses, thefts, damages, or personal injuries that occur during a particular tour or service or for activities booked on third-party sites through our platform.
Third-Party Operated Services
Il Mio Viaggio a New York acts solely as a reseller for certain tours and services operated by third-party companies. Therefore, any liability related to accidents, personal or property damage, loss, or delays during the tour is the sole responsibility of the operating company or its representatives. By purchasing and accepting these Terms and Conditions, the customer expressly acknowledges that Il Mio Viaggio a New York cannot be held responsible for events occurring during the provision of services by a third-party operator. Any dispute regarding services purchased through Il Mio Viaggio a New York is subject to the exclusive jurisdiction of the courts of the State of New York, except when the service is provided by a third-party operator based in another U.S. state, in which case the competent jurisdiction will be that of the state where the provider is located.

The customer participates in the tour at their own personal risk and accepts all risks, including those arising from the ordinary negligence of Il Mio Viaggio a New York or its staff. -
Limitation of Liability

minor injuries, falls, or discomforts occurring during the tour;

Some services during the tours (e.g., bus transportation, restaurants, freelance guides) are provided by independent third parties. In such cases, any liability arising from accidents, personal injuries, negligence, or service disruptions rests solely with the third-party provider, to the extent permitted by law. -
Acceptance
By confirming the booking and accepting these Terms and Conditions, the customer declares that they have read and understood this waiver and waives any claim of liability against Il Mio Viaggio a New York, except as non-waivable by law.

Exclusive Jurisdiction
The customer agrees that any dispute or claim related to participation in tours or services purchased through Il Mio Viaggio a New York shall be subject to the exclusive jurisdiction of the courts of the State of New York, USA. Any legal claim or dispute will be handled exclusively in the courts of the State of New York (USA), expressly excluding the jurisdiction of any Italian or European court, except as non-waivable by law.
Purchasing on our platform or at our physical office constitutes automatic acceptance of our terms and conditions.
